Policies & Procedures

Deposit
• A facility deposit is requited within thirty (30) days after the initial
reservation to hold a facility. If no deposit is received, and another
client has requested the same facility, the initial client will be offered
the first right of refusal and have three (3) working days (Monday-Friday)
to send in the specified deposit. If no deposit is received after the thirty
(30) day period, the reservation will be released. Prior to receipt of the
partial deposit, prices and offerings are subject to change without notice.
A partial payment of 50% of the projected fee is required thirty (30) days
prior to the event. Upon receipt of the partial payment, all prices and
offerings are confirmed.

Designated Contact
• The client agrees to coordinate the event with a designated primary
contact within the Facility Rentals Department before, during and after the
event. The Living Desert employees will only respond to their supervisors
and/or a designated Living Desert liaison during the event. The Living
Desert will attempt to accommodate last-minute changes and requests,
however, it reserves the right to assess additional labor charges and/or
product charges if appropriate.

Cancellations
• If the client cancels prior to thirty (30) days of the reserved date, a
facility deposit may be refunded less any portion spent on behalf of client
request. If the cancellation occurs more than fifteen (15) days but less
than twenty-nine (29) days, the facility deposit shall not be refunded.
Cancellations falling within fourteen (14) days of the reserved date will be
subject to a loss of the facility deposit and up to 50% of the projected
total (of the partial payment already made). Such out-of-pocket expenses
could include scheduled labor or rented equipment.

Alcoholic Beverages
• All beverage service will be provided by The Living Desert and is subject
to the regulations of the Alcoholic Beverage Control Board of California.
The Living Desert reserves the right to refuse service to anyone. A corkage
fee of $10.00 per bottle will be charged on beverages not available through
The Living Desert’s Beverage & Wine list and brought in by the client.
Consumption of all alcoholic beverages will be confined to the event area.
Persons under 21 will not be served. If consumption appears to be excessive,
that client will be given a courtesy notice. Failure to control the
situation will result in immediate cessation of bar services, but all bar
guarantees and labor charges will be invoiced.

Decorations/Theming/Entertainment
• All decorations, theming and entertainment must be approved by The Living
Desert representatives at least fourteen (14) days prior to the event. The
Living Desert reserves the right to refuse any decoration, theming or
entertainment that may be considered a health or safety problem or cause
damage to the property. No balloons or fireworks are allowed.

Indemnity Clause
• Client shall indemnify and hold The Living Desert harmless from any claim,
liability, loss, damage, cost, expense, including reasonable attorneys’
fees, award, fine or judgment with respect to, or arising out of, the use
of the facilities. This includes, without limitation, any such claims,
liability, loss, damage, cost, expense, award, fine or judgment arising by
reason of death or bodily injury to persons, injury to property arising by
reason of client’s alleged or actual negligent act, regardless of whether
such act is active or passive. Client shall not be obligated to indemnify
The Living Desert with respect to the sole negligence or willful misconduct
of The Living Desert, its agents, servants, or employees who are directly
responsible to contractor.

Code of Conduct for Private Events
• So that all visitors may enjoy their experience at The Living Desert, all
visitors at their facilities are expected to conduct themselves in a
gentlemanly/ladylike manner at all times while on the premises. Any behavior
which authorized personnel deems to be unlawful, disruptive, or
objectionable to other visitors or employees, or potentially or actually
damaging to the animals, plants or property of The Living Desert or to other
persons, shall be cause for refusal or revocation of admission or continued
presence at The Living Desert.

The aforementioned guidelines have been established in order to provide
clients with the best possible special event at The Living Desert.
Compliance with these policies will be enforced to insure that both the
clients and The Living Desert have the same expectations for the event.
